Applying for permission for special use

  • Service description

Anyone can use public roads, paths and squares as intended. If you want to use them for anything other than the intended purpose, you generally need a special use permit.

Examples of when a special use permit may be required include

    • Construction site facilities
    • Sale of goods of all kinds
    • Setting up tables and chairs for outdoor catering
    • Erection of scaffolding and containers
    • Events and street festivals

If a permit for excessive road use or a special permit is required under the provisions of the StVO, no special use permit is required (Section 41 (7) LStrG). Before making its decision, the authority responsible for this will instead consult the authority otherwise responsible for the special use permit. The special use permit thus becomes part of the road traffic permit.

  • What documents are needed?

    • Main application:
      - informally or by form
    • Evidence (optional, depending on the type of special use):
      - Scaled site plan
      - Photos / drawings of the site
      - Site layout plan

    Among others:

    • written application for a permit to hold an event in the public street space with information on the number of participants, schedule, etc.
    • written confirmation by the organizer that the organizer is aware that the event constitutes a special use within the meaning of the Federal Highway Act or the corresponding provisions in the road laws of the federal states. In particular, the declaration must confirm knowledge of the claims for reimbursement under road law, according to which the permittee must reimburse all costs incurred by the road authority as a result of the special use. (Cost assumption declaration (as part of the organizer declaration)),
    • Organizer declaration
    • Confirmation from the insurance company for submission to the StVB regarding liability insurance coverage for an event.
    • Route plan
    • Insurance certificates (e.g. for accident insurance)
    • If necessary, traffic sign plan and detour plan, if roads have to be closed
  • What are the fees?

    • Cost type: variable
      - The cost amount varies depending on the type, period and area of the special use.
      - The cost amount depends on the respective fee schedule.

The fee is based on the Fee Regulations for Road Traffic Measures (GebOSt) and currently ranges from 10.20 euros to 767.00 euros - up to 2,301.00 euros for larger events with exceptionally high administrative costs.

In addition to the fee for issuing the permit, separate fees may be charged for the special use of the roads.

  • What deadlines do I have to observe?

    • Deadline type: Application deadline
      Note: There is no deadline.

    • F rist type: Period of validity
Remark: Limited in time or revocable.

    • Type of deadline: Objection deadline
Note: The statutory objection deadline applies.

The application must be submitted in good time, at least two weeks before the start of the event - and correspondingly earlier in the case of large and, above all, multi-area events (extended hearing procedure required).

  • Processing time

The processing time varies depending on the type of special use.

    Depends on the individual case.

  • Legal basis

  • Applications / Forms

    • Forms available: Yes
    • Written form required: No
    • Informal application possible: Yes
    • Personal appearance required: No

Permission may be granted upon written application.

The Federal Ministry of Transport has issued appropriate forms for the procedure, which are generally also available from the road authorities. The road traffic authority examines the application and the documents submitted and consults the bodies to be involved (including the police and road authorities, forestry and nature conservation authorities).

  • Comments

Due to the complexity of large events in particular, but also due to the basic coordination of the event with other traffic events (e.g. work sites on roads, etc.), it is advisable to contact the locally responsible road traffic authority by telephone in good time, during which further details and particulars can also be discussed.
