    In order to ensure the peace and quiet of Sundays and public holidays and the rest of the sales staff, sales outlets are generally closed on Sundays and public holidays. A maximum of four general sales-open Sund ays per year per municipality may be released by legal ordinance. There is no claim against the municipality for the release of open Sundays. The permitted opening time may not exceed five hours; it may not be between the hours of 6 a.m. and 11 a.m.

  • What documents are needed?

    An application must be submitted stating who the organizer is, e.g. Werbegemeinschaft der Stadt XY, when the open Sunday is to be and in which district it is to be held.

  • What are the fees?

    There are no fees to pay.

  • What deadlines do I have to observe?

    Since a hearing procedure is mandatory, the application should be received by the authority approximately six weeks before the planned Sunday on which sales are to take place.

    It is necessary that the municipalities, as the issuers of the ordinances, carry out a sufficient weighing up between the need for regulation for the release of a Sunday open for sales and the protected good of the Sunday before making a decision to release a Sunday open for sales. This weighing decision is to be attached to the draft of the RVO as justification when hearing the trade unions, employers' and business associations, churches and other relevant institutions.

    It should be noted that no holidays can be released for reasons of holiday protection. The Shop Opening Act also stipulates that sales outlets may not be kept open on Easter Sunday, Whit Sunday, Remembrance Day, Dead Sunday, Advent Sundays in December and Sundays on which a public holiday falls.

    The release of the 1st Sunday of Advent in November is possible. No "consecutive" Sundays may be released. The respective release is to be seen parish-related.
