Building permit exemption procedure

The erection, alteration, change of use and demolition of structural facilities (e.g. buildings) require a building permit. However, this only applies if the Rhineland-Palatinate Building Code does not stipulate otherwise, such as in the catalog of projects not requiring a building permit, in the exemption procedure and projects not subject to building supervision.
In the exemption procedure, the municipality decides whether a building project that would normally require planning permission can be carried out without planning permission due to its location in a development plan or whether a planning permission procedure should be carried out.
What deadlines do I have to observe?
The project may commence one month after receipt of the required building documents by the municipal administration; if the municipality informs the client in text form before the expiry of the deadline that no approval procedure is to be carried out, the client may commence the project before the expiry of the one-month deadline (Section 67 (2) LBauO).
The execution of the project, including the excavation of the building pit, may then only begin if the client has notified the building supervisory authority of the start of the construction work in text form at least one week in advance (Section 77 (1) LBauO).
The right to execute the project expires if the project has not been commenced within four years of the requirements of Section 67 (2) sentence 1 LBauO being met or if execution has been interrupted for four years; Section 74 (1) sentence 2 LBauO applies accordingly.
